These Terms govern the use of PowerGate (powergate.me), operated by Oliver Belavic (see Imprint). By creating an account or using a gate link, you agree to these Terms.
You must provide accurate information when registering. You're responsible for keeping your login credentials confidential and for all activity under your account. Accounts are personal to the Creator who registered them.
PowerGate lets Creators upload tracks, define required steps a Fan must complete, and share a link. SoundCloud steps are verified in real time via the SoundCloud API. Spotify and Instagram follow steps are self-reported by the Fan — PowerGate does not verify these two independently (see the How It Works page for why: neither platform offers a way to check this without an OAuth login flow that caps out at a handful of real users under their current developer terms).
You retain ownership of everything you upload. By uploading Content, you confirm you have the necessary rights to distribute it through PowerGate, and you grant PowerGate a limited, non-exclusive license to store, process, and make that Content available to Fans solely for the purpose of operating the gate you created — nothing broader than that. We do not claim ownership of your Content and do not use it for any purpose beyond running the service you asked for.
You are solely responsible for Content you upload, including ensuring you have the rights to distribute it (e.g. as the original creator, or with permission from sample/rights holders).
Downloads obtained through a gate are for personal, non-commercial use unless the Creator states otherwise. Redistributing, reselling, or publicly re-uploading a downloaded track without the Creator's permission is not allowed.
Gates may require interacting with SoundCloud, Spotify, or Instagram. Your use of those platforms is governed by their own terms — PowerGate is not responsible for their availability, functionality, or any changes they make that affect how a gate step works.
SoundCloud actions (repost/like/comment/follow) are verified for real via the SoundCloud API at the time a Fan completes them. Spotify and Instagram follow steps are self-reported — a Fan clicking “I followed” is not independently confirmed. Creators should design gates with this distinction in mind.
If a Creator enables the email step, the email a Fan provides is shown to that Creator in their dashboard. PowerGate does not currently provide any bulk-export or marketing-send feature for collected emails, and does not itself send marketing email to Fans using data collected through a gate.

PowerGate is provided on a best-effort basis, currently in beta. We don't guarantee uninterrupted availability and may need to take the service down for maintenance or due to issues with third-party providers we depend on (hosting, storage, SoundCloud's API, etc.).
The service is provided “as is”. We don't warrant that gate verification will always work flawlessly, especially where it depends on third-party APIs outside our control (e.g. SoundCloud, Spotify).
Our liability for damages is limited to cases of intent and gross negligence. For slight negligence, we are only liable for breach of an essential contractual obligation (a duty whose fulfillment is necessary for the proper performance of the contract, and on which you may typically rely), and in that case liability is limited to the foreseeable, typically occurring damage. This limitation does not apply to injury to life, body, or health, or to liability under mandatory statutory provisions (e.g. product liability law).
If your uploaded Content or use of the service causes a legitimate third-party claim against PowerGate (e.g. a copyright claim over Content you uploaded without the rights to), you agree to reasonably cooperate with and hold PowerGate harmless for costs directly resulting from your breach of these Terms.
We may suspend or terminate an account that violates these Terms, in particular for repeated copyright infringement or abuse of the verification system. You can delete your own account and gates at any time.
We may update the service or these Terms as PowerGate develops. We'll reflect material changes here with an updated date.
These Terms are governed by German law. Mandatory consumer-protection provisions of your country of residence, if you are a consumer, remain unaffected.
